Abstract

Social theory of society explains that society is the basis of the formation of the state and society. This theory explains the phases of the formation of a state, namely the phase of society before the state and the phase of society after the state where before the formation of the state, society is a collection of individuals who enter into an agreement that forms an agency that aims to unite individuals in a collection of groups or communities. The agreement then becomes the basic foundation in Government administration known as the Constitution which is a set of foundations and basics principle a country to organize the government and state. The Government’s and the people’s desires to achieve as a part of group. In the constitution itself there are several principle agreements such as the Governmet System, Structure of State Power, State Institutions, Non-Structural State Institution, General Principle of Good Governance, Human Rights, and General Elections. Every countries has similarities and differences in contents of its constitution. As law studies known comparative law subject which is a legal research conducted to analyze and comparing a law in a country with other countries to see the similarities and differences which can be used as input and consideration in carrying out legal reform of legal. In this thesis, author was done a legal comparation based on Constitution between Indonesia and Libya as the subject of the legal comparataion. Author uses the subjects of the state of Indonesia and Libya as objects of legal comparison in the government system based on the Undang-Undang Dasar 1945 Indonesia and 2011 of Libya Constitution.
